The Internet Corporation for Assigned Names and Numbers (ICANN) has recently announced that internet web domains are to be dramatically expanded beyond the existing “.com” and “.co.uk” etc domains. This will enable business to be more flexible and customise their web domains. For example, this may include companies such as “BMW” having web addresses like “www.car.bmw” or “www.3series.bmw”.
An interesting article published by the Financial Times,
however, highlights the difficulties businesses may face as they
struggle to protect their intellectual property
from “cybersquating” (the concept of opportunists
acquiring a domain name which is valuable to an
exiting business).

Since 6 April 2003, eligible employees (i.e. biological fathers or the spouse or partner of the child's mother/primary adopted – subject to other qualifying requirements), have been entitled to ordinary paternity leave ('OPL'). In summary new law which recently came into effect means that an eligible Employee: (A) whose baby is due; or (B) whom has been notified of having been matched for adoption on or after 3 April 2011 will now also be entitled to take Additional Paternity Leave ('APL') APL is an entitlement to take up to 6 months' leave if the child's mother (or primary adopter) returns to work without taking their full leave entitlement. In essence the new law effectively allows statutory leave to be shared.

A boss who marched an employee down to a police station with a sign saying "Thief" around his neck, after he apparently caught him stealing, has paid £13,000 to the employee after he was sued for "humiliation". From 1st February 2011, the maximum compensatory award for unfair dismissal increases to £68,400 (from the current maximum of £65,300). The new maximum for a week's pay increases from £380 to £400.
The total maximum unfair dismissal award (basic award plus compensatory award) is £80,400.

You may also be aware that a film based on the lives of co founders Mark Zuckerberg and Eduardo Saverin during the developmental stages of the company has been released which sheds some interesting light on the fights and feuds that have affected them, despite all the millions in the bank.
It goes to show how even the simplest issues can affect us all and what
lesson shareholders can take from this sorry tale.

The ruling concluded that such beliefs were not capable of being religious beliefs under the relevant discrimination regulations.

A company must disclose, not only on its business letters,
order forms etc, but also on its website:
• its name;
• the part of the United Kingdom where registered;
• its registered number;
• address of its registered office;
• if exempt from using the word “limited”, the fact that it is a limited company;
• if a community interest company, the fact that it is a limited company; and
• if an investment company within the meaning of section 833 of the Companies Act 2006, that fact.
(The above is required by the Companies (Trading Disclosures)
Regulations 2008 (SI 2008/495) regs 6 and 9, made under
the Companies Act 2006 Part 41. Please note, this is not a definitive list of all information
that must be shown on a website and is limited to information required under the

A recent case in the Employment Appeals Tribunal considered the question of whether an employer is legally obliged to permit an employee to take all of his or her paid leave within the leave year, even if the leave is requested towards the end of the leave year when it may not fit with the staffing patterns of the business.
Regulation 15(4)(a) of the Working Time Regulations specifies that notice given by an employee must be twice as long as the intended holiday. I.e. an employee seeking to take a one week holiday, should give two weeks’ notice and a one day break would require two days’ notice.
The case concluded that an employee could loose their right to the statutory minimum holiday at the end of a leave year, if they failed to give appropriate notice. The full case report can be viewed here.

In a recent case carol singers have been held vicariously liable for promoting various dangerous and/or discriminatory activities. The cause of the problem was singing The Christmas Song, better known as “Chestnuts Roasting On An Open Fire”.
Firstly, by promoting the roasting of chestnuts on an open fire, without drawing to the attention of potential roasters the need to have a risk assessment and adequate safety guards, a claim was brought by two urchins, who suffered severe burns whilst attempting to roast their chestnuts on said open fire.
To make matters worse they then received a claim for inciting an assault against an elderly lady when Jack Frost nipped her nose.
Finally, they caused offence to a group of Inuit exchange students when they made reference to “folks dressed up like “Eskimos” resulting in their arrest for inciting racial hatred!
Chestnuts roasting on an open fire,
Jack Frost nipping on your nose,
Yuletide carols being sung by a choir,
And folks dressed up like Eskimos.

The provisions in the Companies Act 2006 require all companies to deliver annual accounts to the Registrar of Companies by the due date.
Failure to do so may result in the following penalties being incurred:-
| How late? | Penalty Payable |
| Not more than 1 month | £150 |
| More than 1 month but not more than 3 months | £375 |
| More than 3 months but not more than 6 months | £750 |
| More than 6 months | £1500 |
This penalty applies to dormant companies too!

The government propose the introduction of changes to ease copyright protection for non-commercial use of photographs. This is despite the fact that it was not addressed in the new Digital Economy Bill.
The effect of the above may result in non-commercial users no longer being required to pay for the use of photographs or even having to ask to use them.
