A recent case in the Employment Appeals Tribunal considered the question of whether an employer is legally obliged to permit an employee to take all of his or her paid leave within the leave year, even if the leave is requested towards the end of the leave year when it may not fit with the staffing patterns of the business.
Regulation 15(4)(a) of the Working Time Regulations specifies that notice given by an employee must be twice as long as the intended holiday. I.e. an employee seeking to take a one week holiday, should give two weeks’ notice and a one day break would require two days’ notice.
The case concluded that an employee could loose their right to the statutory minimum holiday at the end of a leave year, if they failed to give appropriate notice. The full case report can be viewed here.

In a recent case carol singers have been held vicariously liable for promoting various dangerous and/or discriminatory activities. The cause of the problem was singing The Christmas Song, better known as “Chestnuts Roasting On An Open Fire”.
Firstly, by promoting the roasting of chestnuts on an open fire, without drawing to the attention of potential roasters the need to have a risk assessment and adequate safety guards, a claim was brought by two urchins, who suffered severe burns whilst attempting to roast their chestnuts on said open fire.
To make matters worse they then received a claim for inciting an assault against an elderly lady when Jack Frost nipped her nose.
Finally, they caused offence to a group of Inuit exchange students when they made reference to “folks dressed up like “Eskimos” resulting in their arrest for inciting racial hatred!
Chestnuts roasting on an open fire,
Jack Frost nipping on your nose,
Yuletide carols being sung by a choir,
And folks dressed up like Eskimos.

The provisions in the Companies Act 2006 require all companies to deliver annual accounts to the Registrar of Companies by the due date.
Failure to do so may result in the following penalties being incurred:-
| How late? | Penalty Payable |
| Not more than 1 month | £150 |
| More than 1 month but not more than 3 months | £375 |
| More than 3 months but not more than 6 months | £750 |
| More than 6 months | £1500 |
This penalty applies to dormant companies too!

The government propose the introduction of changes to ease copyright protection for non-commercial use of photographs. This is despite the fact that it was not addressed in the new Digital Economy Bill.
The effect of the above may result in non-commercial users no longer being required to pay for the use of photographs or even having to ask to use them.
